Legal Restrictions on Distribution of MMRRC Materials
The MMRRC's holdings come under one of following mechanisms for distribution:
These agreements specify the terms under which researchers obtain and
use these research materials. In general, the agreements:
- confirm that intellectual property rights remain with the donating investigator or their institution
- do not supercede any patents or other intellectual property rights of third parties
- do not allow further redistribution of materials or derived materials to other
researchers outside the recipient's institution. Where allowed by the agreement, transfers within the
recipient institution imply acceptance of the agreement by intra-mural colleagues.
There are two categories of legal restrictions on the distribution of MMRRC stocks:
patents and donor's restriction to limit distribution to non-profit and academic
research institutions.
- Patents

It is the responsibility of the recipient investigator and their institution to obtain
any licenses or permissions required for the use or transfer of the requested materials.
- Non-Profit Only Distribution

On the Donor MTA, the investigator or their institution may elect to limit distribution
only to non-profit entities. This is the only restriction the MMRRC allows donors
to place on the distribution of their strains; if the election is specified, the MMRRC
is bound to honor it unless the donor institution executes a new Donor MTA without the
limitation elected.
